1. The Playbook Platform

Playbook is a two-sided marketplace that enables independent fitness creators (“Creators”) to publish content, programs, and communities, and enables users (“Users”) to access that content through subscriptions or other purchases.

Playbook does not provide fitness, medical, or health services. Creators are solely responsible for the content they publish and any services they provide.

2. Eligibility

• You must be at least 13 years old to use the Platform.
• If you are under 18, you must have permission from a parent or legal guardian.
• You represent that all information you provide is accurate and current.

3. Accounts & Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You may not share accounts or impersonate others.

Playbook may suspend or terminate accounts that violate these Terms or our policies.

4. Purchases, Subscriptions & Payments

4.1 Payments

‍Payments may be processed through third-party providers, including Stripe, Apple In-App Purchases, and Google Play Billing. Prices are set by Creators unless otherwise stated.

Subscriptions may automatically renew unless canceled prior to the renewal date.

4.2 Refunds & Cancellations

• Subscriptions may be canceled at any time and will remain active until the end of the billing period.
• Refunds are evaluated on a case-by-case basis and are not guaranteed.
• Refund eligibility may depend on the payment processor or app store used.
• Platform fees and third-party processing fees may be non-refundable.

4.3 Free Offers; No Permanent Ownership

‍Creators may, at their sole discretion, make certain content, programs, communities, or other offerings available to Users at no charge (“Free Offers”). By accessing a Free Offer, you acknowledge and agree to the following:

• No Ownership Interest. Access to a Free Offer does not constitute a purchase, license for permanent use, or any form of ownership interest in the underlying content. You receive a limited, revocable, non-exclusive right to access the Free Offer solely through the Platform and solely for such duration as the Creator, in their sole discretion, makes it available to you.
• Revocability. The Creator who made a Free Offer available reserves the right to modify, restrict, or revoke your access to that Free Offer at any time, for any reason or no reason, without notice and without liability to you of any kind. Playbook similarly reserves the right to remove Free Offers from the Platform at any time in accordance with its policies.
• No Compensation Upon Revocation. Because no payment was made in connection with a Free Offer, revocation of access does not entitle you to any refund, credit, compensation, or substitute offering.
• No Guarantee of Continued Availability. Playbook makes no representation that any Free Offer will remain available for any particular duration. You should not rely on the continued availability of any Free Offer for any purpose.

5. Creator–User Interactions

Creators may communicate with Users through community posts, comments, or direct messages. You are solely responsible for your interactions.

Playbook is not responsible for disputes, claims, or interactions between Creators and Users.

6. Content & License

You retain ownership of any content you submit to the Platform.

By posting content, you grant Playbook a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, distribute, display, and promote such content solely in connection with operating, improving, and marketing the Platform.

7. Health & Fitness Disclaimer

All fitness content on Playbook is provided for educational and informational purposes only.

You acknowledge and agree that:

• Participation is at your own risk
• You should consult a qualified medical professional before beginning any fitness program
• Playbook is not responsible for injuries, health conditions, or damages resulting from use of the Platform or content

8. Acceptable Use & Community Guidelines

You agree not to:

• Post unlawful, infringing, deceptive, or harmful content
• Make medical claims or guaranteed fitness outcomes
• Harass, abuse, or exploit others
• Circumvent payments or platform safeguards

Playbook may remove content or suspend accounts that violate these standards.

9. Termination

Playbook may suspend or terminate your account at any time, with or without notice, if you violate these Terms or applicable policies.

Termination may result in loss of access to content, subscriptions, or earnings.

10. Disclaimers

The Platform is provided “as is” and “as available.” Playbook disclaims all warranties, express or implied, including fitness for a particular purpose.

11. Limitation of Liability

To the maximum extent permitted by law, Playbook will not be liable for indirect, incidental, consequential, or punitive damages. Playbook’s total liability will not exceed $100 USD.

12. Arbitration & Governing Law

Disputes will be resolved by binding arbitration on an individual basis. These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles.
